By accessing Pemphis.com and purchasing our botanical specimens, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.
1. International Shipping & Regulations
Pemphis.com facilitates the export of living botanical specimens. However, it is the buyer's sole responsibility to ensure that the imported goods comply with their country's specific agricultural and customs regulations. We provide necessary Phytosanitary Certification, but we are not liable for customs delays, seizures, or destruction of goods due to local import restrictions or lack of required permits by the buyer.
2. Botanical Nature of Products
Bonsai specimens are living organisms. While we ensure every tree is healthy and well-prepared before shipment, environmental factors during transit such as temperature changes and duration may impact the tree's condition. We take extreme care in our specialized packaging to mitigate these risks.
3. Payments and Currency
All prices are listed in USD unless otherwise stated. Payment must be cleared in full before any export procedures begin. We accept PayPal, major Credit Cards, and International Bank Transfers. Any bank fees associated with international transfers are the responsibility of the buyer.
4. Limitation of Liability
Pemphis.com is not responsible for any damage to the specimens occurring after the shipment has been handed over to the courier service. Our responsibility ends upon proof of delivery to the destination country's customs or the address provided by the buyer.
5. Returns & Refunds
Due to the nature of living bonsai specimens and the complexities of international export/import laws, all sales are final. We do not accept returns. Refunds are only considered in exceptional circumstances where Pemphis.com is proven to be at fault in the preparation or documentation process, subject to our internal review.
6. Governing Law
These terms are governed by and construed in accordance with the laws of Indonesia. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts in East Java, Indonesia.
